Creative Information Pty Limited (ABN ABN 001 627 498) (“we”, “us”, “our”, “Creative Information”, “Yujin AI”) is based in New South Wales, Australia, and operates the Yujin AI platform – an AI-powered personal assistant companion service available via yujin.ai and related websites and mobile applications.

1.2 About These Terms

By accessing or using Yujin AI, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our service.

These Terms and Conditions govern:

Your access to and use of the Yujin AI platform (website and mobile applications)
Your subscription to Yujin AI services
The relationship between you and Creative Information

1.3 Modification of Terms

We may modify these Terms and Conditions at any time without prior notice. When we make changes:

The “Last Updated” date at the top will be revised
We will notify you via email or through the platform
Continued use of Yujin AI after changes constitutes acceptance of the updated terms
Pre-existing terms continue to apply to subscriptions purchased before the change takes effect

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 18 years of age to use Yujin AI. By creating an account, you confirm that you are 18 years or older.

2.2 Account Registration

To use Yujin AI, you must:

Provide accurate and complete registration information (first name, last name, preferred name, email address)
Complete two-factor authentication via mobile phone number
Create a secure password
Accept these Terms and Conditions and our Privacy Policy

2.3 Account Security

You are responsible for:

Maintaining the confidentiality of your password
All activities that occur under your account
Notifying us immediately of any unauthorized access or security breach

Do not share your password with anyone. We will never ask for your password via email or phone.

2.4 Account Accuracy

2.5 One Account Per Person

Each person may maintain only one active Yujin AI account. Multiple accounts by the same person are prohibited.

3. The Yujin AI Service

3.1 Service Description

Yujin AI is an AI-powered personal assistant companion that:

Learns about you through conversations and interactions
Maintains a personalized Social Graph of your relationships
Builds a Lifestyle Profile based on your interests and preferences
Provides personal assistant features (reminders, calendar management, task scheduling)
Delivers contextually relevant conversations and interactions
Offers news, content, and information aligned with your interests

3.2 Service Availability

We strive to provide continuous service availability, but we do not guarantee that:

The service will be uninterrupted or error-free
All defects will be corrected immediately
The platform or servers are free from viruses or harmful elements

We reserve the right to:

Modify, suspend, or discontinue any aspect of the service
Perform scheduled maintenance with reasonable notice
Implement emergency maintenance as needed

3.3 Beta and Experimental Features

Some features may be offered as “beta” or “experimental.” These features:

May be unstable or incomplete
May be modified or discontinued without notice
Are provided “as is” without warranty

4. Subscription and Payment

4.1 Subscription Model

Yujin AI operates on a subscription basis. Subscription tiers include:

Free Trial: 30-day trial with full access to basic features
Basic Subscription: Monthly subscription for core personal assistant features
Premium Add-ons: Optional feature packs (social media integration, content packs, advanced capabilities)

Pricing is displayed on our website and is subject to change with reasonable notice.

4.2 Free Trial

New users receive a 30-day free trial of Yujin AI. During the trial:

You have access to basic features
Your AI Companion builds memory and learns about you
No payment is required

After the trial:

If you do not subscribe, your Companion’s memory will be deactivated
Your data will be deleted 30 days after trial expiration unless you subscribe
You may reactivate your account by subscribing within the 30-day grace period

4.3 Payment Terms

By subscribing, you agree to:

Pay the subscription fee displayed at the time of purchase
Authorize recurring monthly charges to your payment method
Provide valid payment information (credit card, debit card, or other accepted methods)

Accepted Payment Methods:

Visa, MasterCard, American Express
PayPal
Other payment methods as may be offered

4.4 Billing and Automatic Renewal

Subscriptions automatically renew on a monthly basis unless cancelled. By subscribing:

You authorize us to charge your payment method each billing cycle
Charges occur on the same day each month (or the last day if your start date doesn’t exist in a given month)
You will receive a receipt via email after each successful payment

4.5 Price Changes

We may change subscription prices with 30 days’ notice:

We will notify you via email before the price change takes effect
The new price will apply to your next billing cycle after the notice period
You may cancel your subscription before the new price takes effect

4.6 Taxes

Prices are stated in Australian dollars (AUD) and exclude GST unless otherwise stated. You are responsible for:

4.7 Payment Failures

We will attempt to re-process the payment

4.8 Refund Policy

Refunds are provided under the following circumstances:

Cooling-off period: Cancel within 7 days of initial subscription for a full refund
Service failure: If we fail to provide the service as described, you may be entitled to a refund
Billing errors: If we incorrectly charge you, we will issue a refund

No refunds for:

Partial billing periods (if you cancel mid-month)
Free trial periods (no payment, no refund)
Change of mind after the 7-day cooling-off period

5. Subscription Management

5.1 Cancellation

You may cancel your subscription at any time by:

Accessing your account settings and selecting “Cancel Subscription”

Upon cancellation:

You will retain access until the end of your current billing period
No further charges will be made
Your account will be downgraded to inactive status
Your data will be retained for 60 days, then deleted

5.2 Subscription Hold

You may place your subscription on hold for up to 6 months:

Your account and data will be preserved
No charges will be made during the hold period
You can reactivate at any time
After 6 months, the subscription will automatically cancel

5.3 Account Deletion

You may delete your account at any time:

All your data (LifeGraph (Personal Social Graph), Lifestyle Profile, conversation history) will be permanently deleted
Deletion is irreversible
If you have an active subscription, it will be cancelled (no refund for partial periods)

6. User Conduct and Prohibited Uses

6.1 Acceptable Use

You agree to use Yujin AI:

In compliance with all applicable laws and regulations
For lawful purposes only
In a manner that respects the rights of others

6.2 Prohibited Conduct

You may not:

Use the service for any illegal, harmful, or fraudulent purpose
Attempt to gain unauthorized access to our systems or other users’ accounts
Interfere with or disrupt the service or servers
Use automated means (bots, scripts) to access the service without authorization
Reverse engineer, decompile, or disassemble any part of the service
Sell, resell, or commercially exploit the service without our permission
Upload viruses, malware, or other malicious code
Impersonate another person or entity
Harass, abuse, or harm others through the service
Use the service to spam or send unsolicited communications
Violate any third-party rights (intellectual property, privacy, etc.)

6.3 Consequences of Violation

If you violate these terms, we may:

Issue a warning
Suspend your account temporarily
Terminate your account permanently
Report illegal activity to law enforcement
Take legal action to recover damages

7. Intellectual Property

All content, features, and functionality of Yujin AI are owned by Creative Information and protected by:

Website design and user interface

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Access and use Yujin AI for personal, non-commercial purposes
Download and use our mobile applications on your devices
Access materials provided through the service

You may not:

Copy, modify, or distribute our intellectual property
Create derivative works based on our service
Remove or alter any copyright, trademark, or proprietary notices

7.3 User Content

You retain ownership of the information you provide to Yujin AI (your Social Graph, Lifestyle Profile, conversations, etc.). However, by using the service, you grant us a license to:

Store and process your data to provide the service
Use aggregated, anonymized data for research and improvement
Display your content back to you within the service

We do not claim ownership of your personal information or conversations.

7.4 Feedback

If you provide feedback, suggestions, or ideas about Yujin AI:

We may use them without obligation to you
You grant us a perpetual, worldwide, royalty-free license to use such feedback
We are not required to keep feedback confidential

8. Third-Party Services and Links

If you need professional advice, consult a qualified professional. In an emergency, contact local emergency services.

10.3 AI Learning

Your AI Companion learns from your interactions to improve personalization. This learning is:

Specific to your account
Not shared with other users
Used to improve your individual experience

We may also use aggregated, anonymized data from all users to improve the overall AI system.

10.4 Personality and Content

AI Companion personalities and conversational styles are:

Configurable within acceptable parameters
Subject to content moderation and safety guidelines
Not intended to replace human relationships

We reserve the right to restrict or modify personality features that violate our policies.

11. Disclaimers and Warranties

11.1 Service Provided “As Is”

Yujin AI is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

Accuracy, reliability, or completeness

Nothing in these terms excludes, restricts, or modifies any guarantee, warranty, term, or condition, right, or remedy implied or imposed by any Australian consumer protection legislation (including the Australian Consumer Law) that cannot lawfully be excluded, restricted, or modified.

If the Australian Consumer Law or other applicable law implies a guarantee or warranty that cannot be excluded, our liability for breach of that guarantee or warranty is limited, at our option, to:

For services: Re-supplying the services or paying the cost of re-supply
For goods: Replacing or repairing the goods or paying the cost of replacement or repair

12. Limitation of Liability

12.1 Exclusion of Liability

To the maximum extent permitted by law, Creative Information and its directors, employees, agents, and affiliates are not liable for:

You engage in fraudulent, illegal, or harmful conduct
Your account remains inactive for 2 years (after 30-day notice)
We are required to do so by law
We discontinue the service (with reasonable notice)

14.3 Effect of Termination

Upon termination:

We will cancel your subscription (no refund for partial periods unless required by law)
Your data will be deleted in accordance with our Privacy Policy
Sections that should survive termination (e.g., intellectual property, limitation of liability) remain in effect
